1. Introduction and Scope
This Acceptable Use Policy (the "AUP") sets forth the categories of Content and conduct that are prohibited on the Platform operated by JAYOBE, Inc. ("JAYOBE") at jayobe.io. The AUP is incorporated into the JAYOBE Terms of Service (the "Terms"), located at jayobe.io/terms, by reference in its entirety and forms a part of the Terms. Capitalized terms used but not defined in this AUP have the meanings given to them in the Terms.
This AUP applies to all Users, including Employers and Job Seekers. Specific provisions apply to Listings, to Employer account conduct, and to Job Seeker account conduct, as set forth in the sections below. All Users are additionally subject to the platform-integrity provisions set forth in Section 5.

This AUP applies to all Users of the Platform located anywhere in the United States, including all fifty (50) United States, the District of Columbia, and U.S. territories. The substantive prohibitions set forth in Sections 2 through 5 apply uniformly to all Users regardless of state of residence. Where a specific prohibition is tied to jurisdiction-specific law (for example, ban-the-box restrictions in certain states), the Employer remains solely responsible for compliance with the law applicable to the jurisdiction where the role is to be performed.
A violation of this AUP constitutes a violation of the Terms. Violations may be enforced through any remedy available under the Terms, including Content removal, Listing removal, account suspension, and account termination, as further described in Section 6 of this AUP and in Sections 8.5, 9.9, and 20.2 of the Terms.
Disputes arising under or relating to this AUP, including disputes about JAYOBE's enforcement of this AUP, are resolved under the arbitration procedures set forth in Section 18 of the Terms, subject to the carve-outs and opt-out right described in that Section. The opt-out right includes a time-limited window after first acceptance of the Terms for a User to opt out of arbitration by written notice to legal@jayobe.io, as set out in Section 18.8 of the Terms. The governing law, venue, and class action waiver provisions in Sections 18 and 19 of the Terms apply to this AUP.
The prohibitions set forth in this AUP are not exhaustive. JAYOBE reserves the right to determine, in its reasonable good-faith discretion, whether any Content or conduct violates this AUP or is otherwise inconsistent with the purpose of the Platform. In the event of any conflict between this AUP and the Terms, the Terms govern, except with respect to the specific prohibitions set forth in this AUP that are not addressed in the Terms.
